| 摘 要： | 保证期间应为保证人能够容忍债权人不积极行使权利的最长时间，保证期间的性质应为一种特殊的权利行使期间，是一种独立的期间形态。担保法关于一般保证期间中断的规定是一种法律准用规则，连带责任保证期间如债权人在保证期间内向保证人主张权利，也应视为保证期间中断。保证合同不应有诉讼时效。

| Abstract: | Guaranteeing period refers to the ultimate time for guarantors to bear loaner who couldn't use the right. The character of this period is that it is a special time for right. The regulation of the break in the course of guaranteeing period is a law permitted regulation. Guaranteeing contract shouldn't have time limitation. |
