| 摘 要： | 非法证据排除规则是现代法治建设的重要内容,是刑事诉讼中最重要的证据规则之一,它对保证司法公正、维护当事人的合法权益有着重要的意义。非法证据排除规则在很多国家都已确立,但对于我国刑事诉讼中的非法证据排除问题,学界与理论界存在较多争议。加强对非法证据排除规则的研究与探讨,对于建立我国的刑事诉讼规则具有重要的意义。

| Abstract: | Exclusionary rule of illegally obtained evidence is the crucial component of modern rule of law,as one of the most important rules in criminal procedures,which is of vital significance to the guarantee of judicial justice and protection of legitimate interests of the parties involved. The exclusionary rule of illegally obtained evidence has been established in many countries,and there is a hot debate on this rule in China. The research on exclusionary rule of illegally obtained evidence is crucial to the establishment and perfection of the criminal procedure rules in China. |
