| 摘 要： | 胎儿民事权益的保护是我国法律所面临的一个十分现实的问题。传统民法理论认为，胎儿是母体的一部分而不是独立的个体，胎儿不能作为权利义务的主体。但是，这一理论会损害胎儿的合法权益。鉴于此，各国对胎儿权益进行了一定的保护。相比之下，我国大陆地区的民事立法对胎儿权益的保护则显得比较滞后。在《民法典》制定之际，应对胎儿利益的保护进行更多的研究，以期完善立法，更好地维护胎儿的利益。
