| 摘 要： | 我国监护制度主要规定在《中华人民共和国民法通则》(以下简称《民法通则》)第二章第二节中，《最高人民法院关于贯彻执行(中华人民共和国民法通则)若干问题的意见》(以下简称《高院意见》)一公民(二)中作了补充规定。以上规定构成了我国监护制度的基本框架，为民事审判和司法实践奠定了基础。但是，随着社会的发展及社会关系的复杂化，以上规定日益表现出不足与缺陷。本文拟从监护人与亲权人、监护顺序、监护职责与责任、监护人的指定与管理等方面进行探讨。

| Abstract: | In our country's civil law, guardianship regulations have formulated the relevant stipulates, which forms our country's guardianship regulations' fundamental frame and establishes the foundation for the civil judgments and judicial practice. However, the above-mentioned stipulates have shown some deficiency in process of the social development and connection's complication. This paper tries to discuss this problem in respect of guardians and men of having parental rights, guardianship sequence, guardianship duty and responsibility, guardian assignment and management and so forth. |
