| 摘 要： | 惩罚性赔偿和缺陷产品召回制度在美国有着悠远历史，但在我国是一个有待突破的新问题。由于越来越严重的缺陷产品诉讼案件的屡屡出现，缺陷产品召回制度备受我国法学理论界的关注，同时在司法实践中逐步得到运用，由此引发的问题也是层出不穷，一时间成为学术界争论的热点。
