| 摘 要： | 我国《侵权责任法》在产品责任领域规定了惩罚性赔偿制度,然而还存在不足之处。惩罚性赔偿制度的适用条件过于严格,而赔偿数额又缺乏可操作性的规定,这将影响此制度的价值。文章探讨了该制度的适用范围,和惩罚性赔偿数额确定可操作性的标准。

| Abstract: | Although Tort Liability law has prescribed the punitive damages system in the scope of product liability,it still has some deficiencies.Both the rigorous application conditions and the lacking of the operability in the amount of punitive damages may affect the value of the system.This paper explores the application scope of the system and the operative standard of punitive damage. |
