| 摘 要： | 晚清修律是通过参照域外先进法律文化来完成的.在输入域外法律文化时,清政府优先输入公法文化,再逐步引入私法文化.晚清政府之所以作出这样的选择,既是为了尽快收回领事裁判权,也是考虑到中国传统法律文化具有公法文化的特点,同时也是法律发展后进国家实现由传统法治向近代法治转型过程中的普遍做法.

| Abstract: | Amendments to the Law in Late Qing Dynasty was accomplished by reference to extra-territorial legal culture.In importing and introducing the extra-territorial legal culture,the ruling class of the late Qing Dynasty gave priority to the public law culture,and then gradually introduced private law culture.The reason why the late Qing government made that choice was because the government not only desired to recover the consular jurisdiction as soon as possible,but also took into account the traditional Chinese legal culture containing the characteristics of a public law culture,and this was also the generally practices of less developed countries in legal development that need to achieve modern transformation from by the traditional rule of law to the rule of law and order. |
