| 摘 要： | 随着数字技术的产生和逐渐成熟,数字图书馆将成为未来图书馆发展的主要模式。在数字图书馆的发展过程中,著作权侵权纠纷将无法避免。出于数字图书馆健康发展的需要,其提供实体数字资源而导致的直接侵权行为应当适用无过错责任原则,其提供虚拟数字资源而导致的间接侵权行为应当适用过错责任原则。
