| 摘 要： | 随着数字网络时代的到来,档案形式发生重大变化,从“有形档案”向“无形档案”转变,危害档案安全的档案犯罪也呈现出新形势、新特点,现行刑法的规定日益显示出不能完全适应数字环境下档案安全保护的需要,存在着犯罪主体的复杂多元性、犯罪对象范围狭窄以及行为方式规定的滞后性等问题。为有效发挥刑法作为保障法的功能,需要在数字环境下档案安全刑法保护的理念上强调国有档案与集体、个人档案同等保护的价值取向;在刑事立法上调整刑法的有关规定,做好《档案法》与《刑法》的有效衔接;在刑事司法上完善档案犯罪情节的认定标准,充分发挥刑法治理作用,保障档案安全。

| Abstract: | With the advent of digital network era, the form of archives has changed greatly from "tangible archives" to "intangible archives". As a result, the archival crime endangering archives safety also presents new situation and new characteristics. It is increasingly showed that the provisions of the current criminal law cannot fully meet the need of archives safety protection in digital network era and there are some problems such as the complexity and diversity of criminal subjects, the narrow scope of criminal objects and the lag of behavior regulations. In order to give full play to the function of criminal law as a safeguard law, it is necessary to emphasize the value orientation of equal protection of state-owned archives, collective archives and personal archives in the idea of criminal law protection of archives safety in the digital environment; the relevant provisions of criminal law should be adjusted in criminal legislation to effectively link up the archives law and criminal law; the standard for determining the circumstances of archival crime should be improved in the criminal justice to give full play to the role of criminal law and ensure the archives safety. |
