| 摘 要： | 基于《侵权责任法》的相关规定,探讨网络服务提供者的版权侵权责任。认为对网络服务提供者的版权侵权责任应适用过错责任原则;在认定网络服务提供者的过错时,应将"知道"解释为"明知",并应为网络服务提供者采取必要措施设置必要的门槛;对网络服务提供者的赔偿范围,可采取法定赔偿制度。
