| 摘 要： | 指出固守私权保护向度的技术保护措施已无法全面有效地保护数字时代的著作权,从竞争法向度完善技术保护措施,才能够消解技术保护措施与市场竞争秩序、消费者权益之间的冲突。只有构建符合我国产业发展价值导向的技术保护措施制度,才能实现著作权人及相关权利主体间之利益平衡。

| Abstract: | Due to sticking to the dimension of private right protection,the technical protection measures have been incapable of fully protect the copyright in the digital age.Improving the technical protection in the competition law dimension can eliminate the conflict among the technical protection measures,the market competition order and the consumers’ rights.So building the system of technical protection measures to meet China’s industrial-development-oriented value can balance the interests between the copyright owners and related subjects of the right. |
