| 摘 要： | 目的/意义] 对中外网络经营者收集与传输个人数据行为的法律规范进行对比分析,以期发现我国目前法律规范中存在的具体问题并借鉴先进法律规范经验提出完善建议,从而有效解决我国网络经营者收集与传输个人数据行为日益凸显的问题。方法/过程] 采用比较研究的方法对主要国际组织与国家现行相关法律规范进行梳理与比较,从立法原则、法定义务、法律责任以及特殊用户(即儿童)4个方面,分析对网络经营者收集与传输个人数据行为进行法律规范的异同。结果/结论] 通过比较分析指出我国现行相关法律规范存在着法律规范宽泛笼统、个人数据主体维权困难、缺乏专门监管机构等主要问题,借鉴先进的国外立法经验提出相应的改进建议,对我国相关立法的研究与完善具有一定意义。

| Abstract: | Purpose/significance] This paper contrasts and analyzes the domestic and overseas legal norms of network operators collecting and transmitting personal data behavior. It aims to find out the specific problems in China's legal norms and make some suggestions by drawing lessons from the advanced legal norms for solving the increasingly fierce issues of network operators collecting and transmitting personal data behavior in China. Method/process] Using the comparative approach,we sort out and compare the commons and differences among international organizations and current national legal norms from the aspects of legislation principles,legal obligations,accountabilities and special users(children users). Result/conclusion] Through the comparative analysis above, it points out that China's currentrelative legal norms have main issues. Legal norms are too general, and it is difficult to protect the legal rights and legal norms lackthe specialized regulatory agencies, and learning lessons from foreign advanced experience to make recommendations for improvement. It's meaningful for the China's relevant legal studies and improvement. |
