| 摘 要： | 公知公用专利技术情报的开发与利用是将已被外国授权，但未在我国申请注册，不受我国法律保护的国外有效高端发明专利以及其他国内外先进的公知公用专利技术或项目免费引入，进行消化吸收和再创新，公知公用专利技术情报可以分为法律性失效专利技术情报、时域性失效专利技术情报和地域性失效专利技术情报。公知公用专利技术情报的获取以专利法律状态的检索为主要途径，其中，地域性失效专利技术情报的获取是一个复杂的筛选过程。在公知公用专利技术情报的开发与利用中还需规避一些技术和法律上的风险。

| Abstract: | Development and utilization for information of the public known and used patent technology will import the effective high-end, foreign patents, as well as other domestic and foreign advanced public known and used patent technology, which will have been a foreign license, but did not apply for registration in China and are not subject to China’s legal protection, in order to carry out digestion and absorption and re-innovation. The information of public known and used patent technology can be divided into legal invalid patent technology information, time invalid patent technology information and regional invalid patent technology information. The acquisition for information of the public known and used patent technology is accomplished by searching the patent legal status, in which the acquisition for the regional expired patent technology information is a complex selection process. |
