| 摘 要： | 就2005-2006年在我国信息网络传播权保护法规立法工作进程中，是否应当为公益性图书馆设置网络传播合理使用豁免条款引发的争议问题，从著作权立法基础、原则和现实需求等方面分析《信息网络传播权保护条例》设置该条款的合理性，阐述图书馆界对馆藏作品网络传播的核心诉求，以促进我国信息网络传播权保护法规的进一步完善。

| Abstract: | During the legislative course of Regulations on the Protection of the Right of Communication through Information Network from 2005 to 2006, many disputes have been arisen on whether fair use privilege clauses related to network transmission should be set up for public welfare libraries, This article analyzes the network transmission demand of public welfare libraries, and expounds the rationality to set up fair use privilege clauses in Regulations on the Protection of the Right of Communication through Information Network for public welfare libraries based on legislation foundation, principles and actual requirements. |
