| 摘 要： | 图书馆基于馆藏资源的权利类型包括基于“物”的所有权和基于信息知识的信息权。图书馆权利行使涉及读者的信息权和作品创作者的知识产权。图书馆的可持续发展必须建立在与读者信息权及他人知识产权相平衡的基础上,并对三者权利进行合理的限制。为此,专门的行政法——《图书馆法》之立法势在必行。

| Abstract: | Collection resource-based library rights consists of the following two types,ownership for articles,information rights for information and knowledge.The exercising of library rights involves the readers' information rights and authors' intellectual property rights.Therefore,the sustainable development of a library must base on keeping a balance among those three rights,and imposing a reasonable restriction on them.For this purpose,the legislation of library law is becoming imperative. |
