公立中小学校教师聘任合同建立的基础是教育行政法律关系,首要目的是推行国家教育政策、维护教育公益、实现教育目的。为保证该目标的实现,必然要求教育行政部门和(或)学校享有包括监督和指挥合同履行权、单方变更或解除合同权、对违反合同规定的教师的制裁权在内的行政优先权。而行政优先权的存在又必然使教育行政部门和(或)学校处于与教师地位不平等的状态。如若不通过立法对教师聘任合同行政优先权进行合理控制,必然导致权力腐败、专横以及合同的失控。必须从教师聘任合同行政优先权的内容、程序以及法律救济三个方面进行有效的控制,在充分保障社会公益的基础上,确保教师合法权益的实现。 相似文献

行政相对人的行政创意权是行政相对人所享有的对于行政事务发展格局进行分析、判断并作出预测性建议的权利。其权利主体虽然是行政相对人,但该权的内容却是公权范围内的权利,与公共行政权的行使有着不可分割的联系。它包括制定管理规则的创意权、形成新的法律关系的创意权、构设社会机制的创意权、选择重大行政事务的创意权等基本范畴。设立行政相对人的行政创意权有助于弥补行政法治价值、平衡行政法治主体、拓宽行政法治客体、实现行政法治内容。因此,必须确立行政相对人行政创意权的宪法地位,加强其行政立法保护及实现手段。 相似文献

Students' dislike of learning English literature appears to be the major problem of teaching English literature in China. Reader response approach is a good way to solve this problem.
