《公约》的三种风险负担模式都是建立在双方均无违约的情况下的,但在实践中风险损失往往与违约所造成的损失交合在一起,这种情况下如何进行损失分配即为违约之际的风险负担问题。针对这一问题,由于学界对《公约》第70条的理解不一致而存在很大的分歧。文章在公约框架内,从违约责任与风险负担的一般关系出发,通过对《公约》第70条及其它条文的分析,指出一般性违约不影响风险转移,卖方的根本性违约是否影响风险转移则取决于买方所采取的违约救济措施,而买方的根本性违约则直接导致风险的提前转移。  相似文献

Article 24 of the United Nations Convention on the Rights of Persons with Disabilities (UNCRPD) contains the first legal enshrinement of the right to inclusive education for people with disabilities. The UNCRPD maintains that children with special educational needs and disabilities (SEND) have a basic human right to be educated in mainstream schools. However, this does not take into account their moral right to receive the education most appropriate to their needs. Therefore, it is asserted by this review that fully implementing Article 24 may not be in the best interest of all children with SEND. Article 24 calls for all countries to implement a fully inclusive education system, thereby rendering special education provision obsolete. This review article provides a critique of this possibility, addressing the issues and practical implications involved.  相似文献

The University of Oxford has established a Commission of Inquiry, chaired by its Vice-Chancellor, to define the University's role in the Twenty-First Century. The purpose of this article is to explore the context within which the Commission has emerged and to suggest that it needs to tackle three broad tasks: to define the central purposes of the University, to show how it should be organized to achieve those purposes, and to consider how its activities are to be financed. The article ennumerates the problems that the Commission must tackle while addressing these tasks, and makes suggestions as to its likely recommendations. It concludes by raising the possibility that Oxford's attempt to define its role may help to generate a much needed debate on the future shape of higher education in Britain.  相似文献

Although progress has been made, greater efforts are needed to promote faculty diversity at the college and university levels, especially in STEM fields. Thus, it is important to elucidate best practices both for increasing awareness of diversity issues pertaining to higher education and for implementing change. This article focuses on the outcomes of a diversity workshop for college and university faculty hosted by the West Virginia Higher Education Policy Commission, Division of Science and Research. With a starting point in the tradition of geisteswissenschaftliche Pädagogik, this article presents a challenge to inclusive education research to engage a Continental perspective on educational research. The motivation is to entice inclusive education researchers to begin to ask educational questions of inclusion, as opposed to inclusive questions of education. Recent years has seen a call to re-think inclusive education research and this paper attempts to answer this call by turning to a Continental perspective and the emphasis on an at least relative autonomy for the theory and practice of education. The article explores the relationship between Continental and Anglo-American educational theory, and why they seem to have developed in such distinct directions. Beginning with the Anglo-American perspective, it is outlined how pedagogy and the so-called educational interest became replaced by the scientific standards dominant in other academic disciplines. This is countered by a look at the continued endeavours in the Continental spheres to formulate specifically educational criteria for educational processes. This leads to a negative aim in the form of arguing against neo-liberal policy and the politicisation of inclusive education, and a positive aim in the form of an argument for a move towards constructing a pedagogical ideal of inclusion.  相似文献
