An overview In the patent system of the civil law countries, the utility model patent, also known as the "petty invention", is granted to protect petty inventions that are not highly inventive, but very useful. For example, in the patent systems in Germany and Japan1 can be found provisions concerning utility model patent. After the patent system was launched in mainland China on 1 April 1985, the utility model patent is well received by the industry thanks to the adoption of the "preliminary examination" system to applications for the patent for utility model and the expedited patent grant, and the number of applications of the class is on a rise each year. Within the framework of the patent system in China, the patents for invention, utility mode and design are under the examination of different types: the patents for invention are examined as to substance, and those for utility model and design as to formality only, which renders the patent right for utility model and design relatively less certain and vulnerable to challenge. For example, in the infringement lawsuit involving a patent for utility model or design, the defendant often files a request with the Patent Reexamination Board (PRB) of the State Intellectual Property Office (SIPO) for invalidation of the patent in respect of which the plaintiff, the patentee, has instituted the proceedings in the court. In case like this, the court will suspend the legal procedure under Article 136 of the Several Provisions on Issues Relating to Application of Law to Trial of Cases of Patent Disputes formulated by the Supreme People's Court.  相似文献

Searching for relevant material that satisfies the information need of a user, within a large document collection is a critical activity for web search engines. Query Expansion techniques are widely used by search engines for the disambiguation of user’s information need and for improving the information retrieval (IR) performance. Knowledge-based, corpus-based and relevance feedback, are the main QE techniques, that employ different approaches for expanding the user query with synonyms of the search terms (word synonymy) in order to bring more relevant documents and for filtering documents that contain search terms but with a different meaning (also known as word polysemy problem) than the user intended. This work, surveys existing query expansion techniques, highlights their strengths and limitations and introduces a new method that combines the power of knowledge-based or corpus-based techniques with that of relevance feedback. Experimental evaluation on three information retrieval benchmark datasets shows that the application of knowledge or corpus-based query expansion techniques on the results of the relevance feedback step improves the information retrieval performance, with knowledge-based techniques providing significantly better results than their simple relevance feedback alternatives in all sets.  相似文献

Most existing search engines focus on document retrieval. However, information needs are certainly not limited to finding relevant documents. Instead, a user may want to find relevant entities such as persons and organizations. In this paper, we study the problem of related entity finding. Our goal is to rank entities based on their relevance to a structured query, which specifies an input entity, the type of related entities and the relation between the input and related entities. We first discuss a general probabilistic framework, derive six possible retrieval models to rank the related entities, and then compare these models both analytically and empirically. To further improve performance, we study the problem of feedback in the context of related entity finding. Specifically, we propose a mixture model based feedback method that can utilize the pseudo feedback entities to estimate an enriched model for the relation between the input and related entities. Experimental results over two standard TREC collections show that the derived relation generation model combined with a relation feedback method performs better than other models.  相似文献

Search engines are essential for finding information on the World Wide Web. We conducted a study to see how effective eight search engines are. Expert searchers sought information on the Web for users who had legitimate needs for information, and these users assessed the relevance of the information retrieved. We calculated traditional information retrieval measures of recall and precision at varying numbers of retrieved documents and used these as the bases for statistical comparisons of retrieval effectiveness among the eight search engines. We also calculated the likelihood that a document retrieved by one search engine was retrieved by other search engines as well.  相似文献

To improve search engine effectiveness, we have observed an increased interest in gathering additional feedback about users’ information needs that goes beyond the queries they type in. Adaptive search engines use explicit and implicit feedback indicators to model users or search tasks. In order to create appropriate models, it is essential to understand how users interact with search engines, including the determining factors of their actions. Using eye tracking, we extend this understanding by analyzing the sequences and patterns with which users evaluate query result returned to them when using Google. We find that the query result abstracts are viewed in the order of their ranking in only about one fifth of the cases, and only an average of about three abstracts per result page are viewed at all. We also compare search behavior variability with respect to different classes of users and different classes of search tasks to reveal whether user models or task models may be greater predictors of behavior. We discover that gender and task significantly influence different kinds of search behaviors discussed here. The results are suggestive of improvements to query-based search interface designs with respect to both their use of space and workflow.  相似文献

The relevance feedback process uses information obtained from a user about a set of initially retrieved documents to improve subsequent search formulations and retrieval performance. In extended Boolean models, the relevance feedback implies not only that new query terms must be identified and re-weighted, but also that the terms must be connected with Boolean And/Or operators properly. Salton et al. proposed a relevance feedback method, called DNF (disjunctive normal form) method, for a well established extended Boolean model. However, this method mainly focuses on generating Boolean queries but does not concern about re-weighting query terms. Also, this method has some problems in generating reformulated Boolean queries. In this study, we investigate the problems of the DNF method and propose a relevance feedback method using hierarchical clustering techniques to solve those problems. We also propose a neural network model in which the term weights used in extended Boolean queries can be adjusted by the users’ relevance feedbacks.  相似文献

Many Web sites have begun allowing users to submit items to a collection and tag them with keywords. The folksonomies built from these tags are an interesting topic that has seen little empirical research. This study compared the search information retrieval (IR) performance of folksonomies from social bookmarking Web sites against search engines and subject directories. Thirty-four participants created 103 queries for various information needs. Results from each IR system were collected and participants judged relevance. Folksonomy search results overlapped with those from the other systems, and documents found by both search engines and folksonomies were significantly more likely to be judged relevant than those returned by any single IR system type. The search engines in the study had the highest precision and recall, but the folksonomies fared surprisingly well. Del.icio.us was statistically indistinguishable from the directories in many cases. Overall the directories were more precise than the folksonomies but they had similar recall scores. Better query handling may enhance folksonomy IR performance further. The folksonomies studied were promising, and may be able to improve Web search performance.  相似文献
