保函换取清洁提单问题研究

用保函换取清洁提单 ,在当今的航运实务中被普遍采用。在托运人和承运人之间就签发清洁提单的问题发生了争议时 ,保函可以起到润滑剂的作用 ,避免因此而产生的船期损失 ,从而维护了国际贸易的迅捷性。但是 ,对于这一问题 ,不仅外国法院有不同的主张和判例 ;我国法学界和航运界也各执一说 ,莫衷一是 ,至今 ,国际间没有统一的认识。因此 ,对换取清洁提单的保函 (下称“保函”) ① 进行系统的研究 ,无论在司法实践中 ,还是在航运和对外贸易实务上都有现实意义  相似文献

以反应的准确性为指标,比较了5名受试者在静止、慢走、快走、慢跑和快跑5种状态下的视觉动作反应成绩。结果表明,当视觉刺激呈现的频率不变时,受试者在静止状态下练习所得的视觉动作反应的准确性,在快走、慢跑和快跑状态下会有所下降;在活动状态下反复练习,可以提高该活动状态下的视觉动作反应准确性。  相似文献

The many challenges faced by health sciences libraries of all types and sizes often require innovative solutions. When an innovative solution involves calculated risk taking, the approach is called intrapreneurial. At the University of Miami School of Medicine, an intrapreneurial approach solved the fiscal problems of the biomedical communications unit. The Louis Calder Memorial Library inherited these problems when the Department of the Library and Biomedical Communications was created in the early 1980s. In this paper, two intrapreneurial programs are described, and the benefit and suitability of this management style to information services are demonstrated.  相似文献   

关于筛选16～18岁中学生体质综合评价中心理指标问题的初步研究

心理评价是体质综合评价中不可缺少的重要部分。文章通过对重庆市近600名16～18岁健康男女中学生的测试,以及文献资料的综合研究,对筛选体质综合评价中心理指标的相关问题——心身关系作了较为深入的研究。研究发现,心身在机能上存在相互影响,相互作用,但其机能水平之间却没有数量上的线性关系。通过较为系统的分析讨论,还初步提出将16PF 中的13项指标列为体质综合评价中的心理指标。  相似文献   

Facile and efficient one-pot synthesis of 2-arylbenzoxazoles using hydrogen tetrachloroaurate as catalyst under oxygen atmosphere

In this paper, we presented a novel method for the facile and efficient one-pot synthesis of 2-arylbenzoxazoles, which oxygen atmosphere with anhydrous tetrahydrofuran (THF) as solvent or in solvent-free condition. The results show that this method could bring excellent yields as high as 96%. THF was proven to be the best choice among several solvents screened and the reaction was tolerated with a variety of aromatic aldehydes possessing electron-donating or withdrawing groups. The advantages of the present method lie in catalytic process using economic and environmentally benign dioxygen as oxidant.  相似文献

This study describes response to intervention (RTI) screening and progress‐monitoring instruments and procedures in 41 local school settings. For screening the schools most often used published reading assessments or commercial products; a three‐times‐per‐year screening schedule was most prevalent. For progress monitoring schools most often relied on published reading assessments; a weekly progress monitoring schedule was most prevalent. The variability between local school practices is discussed with regard to efficiency, equity, and viability of RTI.  相似文献
