| 摘 要： | 自然法理论和法律实证主义是法哲学界长期对立并且影响都十分广泛的两种理论，双方主要分歧在于法律与道德的关系方面。自然法理论坚持法律与道德的内在联系，视法律的道德性为其有效性的前提；法律实证主义则在法律与道德之间划出一道截然分明的界线，法律实证主义者并非轻视道德，而是不像自然法理论那样把法律的有效性建立在道德性的基础之上。然而这两种理论晚近的发展却向我们表明了其分别与对方的理论相融合的趋势。

| Abstract: | The natural law theory and the legal positivism are two theories that are antagonistic towards each other, as well as having great influence on the field of philosophy of law. The main difference in principle lies in their respective views on the relationship between law and morality. The natural law theory insists on the intrinsic connection between law and morality. It regards the morality of law as the prerequisites of the validity of law while the legal positivism draws a clear line between the two. Nevertheless the legal positivists have no intention of underrating morality. Only they do not put the validity of law on the basis of the morality of law. However the latest development of the two theories shows a tendency of harmonious combination of each other. |
