| 摘 要： | 任何一种制度、国家体制都是历史的，是在特定的社会发展背景下的现实选择。但同时也是现实和人类理性吁求的发育、发展互动的产物。因此也就当然地存在理性化的观念基础。宪政体制就是建立在一种信仰、一种对一般社会正义观念的接受的基础上的，是观念、逻辑通过假想的现实演绎出来的现实体制。其本身的人性观念基石是人生而平等观念。人生而平等和法律面前人人平等在当今宪政实践中有其不同的价值蕴涵。西方宪政国家的实践目标和平等主题的转换的客观事实以及中国的百年宪政理想和宪政实践的具体历程、历史和文化的沉淀说明了中国自始不存在产生人生而平等进而孕育形式平等观念和制度的条件，只能产生人分类而平等的观念和相应的制度构架。中国社会多年的宪政实践本身实际上是一直将宪政目标服务于国家富强和民族振兴的目标，宪政本身一直未能成为中国社会的独立的价值诉求，现代宪政之道在于培植和建构宪政所需的人性平等观念。

| Abstract: | Any kind of system or national system is all historical, and is the realistic choice under the special development of history. At the same time it is the result of the development of the reality and man's rational demand. So certainly there is an ideal foundation of reason. The purpose of constitutional government system is to set up one kind of faith, one foundation of acceptance of generally social justice idea. It is the realistic system that idea and logic deduce out through the reality of the false appearance. The foundation of normal human feelings itself is that everyone should be equal when they come down. But there are different values of the equality which lies in human life or in front of law in the practice of constitutional government nowdays. Through the transformation analysis of the goal of practice and the equal theme in western constitutional government, and combination of the reflected problems of constitutional government idea during one hundred years and concrete process of practice of constitutional government in China, in my opinion, the history and culture precipitates explain that China hasn't a kind of term which is equal stone of the idea of human nature of the constitutional government that everyone is equal in life, not in front of laws. The meaning of the deep level of structure of the constitutional government in China is to raise and construct an idea on the equality of human nature which constitutional government need. |
