| 摘 要： | 民事再审程序是民事诉讼中的一项重要程序,《民事诉讼法》的修改解决了＂申诉难＂问题。通过审视我国申请再审程序的现状,发现修改后的再审程序在立法理念、再审启动主体与事由、审查程序等方面仍然存在问题,在分析这些问题的基础上,提出了重构我国民事再审程序的立法建议。

| Abstract: | Amendment of the Civil Procedure Law,demonstrated the progress of our litigation system,which highlights the changes to the retrial procedure,the main aim is to address the reality of the ＂complaint difficult＂ problem.Although this modification has a definite progress,but in the legislative philosophy,and the main reason to start a retrial,review procedures,there are still many inadequacies in the theory and practice in this article from the perspective of some of the recommendations put forward in order to improve China＇s civil retrial procedures. |
