法理学视野下义务教育的公平性

摘    要:义务教育是一项公益性事业,是所有适龄儿童、少年必须接受的教育,是由国家统一实施并必须予以保障的。义务教育的公平实现,不仅依赖于义务教育的配套措施的健全,更有赖于义务教育理念的提升。而义务教育理念的提升又依赖于对义务教育本身的理解。从法理学角度来厘清义务教育中的权利、义务,并从法的基本价值角度来理解义务教育的公平性,进而具体探讨实现义务教育的公平性的法理途径。

Abstract:Compulsory education is a public welfare undertakings that countries must be guaranteed,which is the national unified implementation of all school-age children and adolescents that must accept education. Fair implementation of compulsory education not only relies on the supporting measures of compulsory education of the healthy, relies on the concept of compulsory education to ascend, and, the development of compulsory education concept depends on the understanding of the compulsory education itself. Try from the term of jurisprudence in the compulsory education rights, obligations, from the view of the basic value of law to understand the fairness of compulsory education, to realize the legal way of compulsory education fairness is detailed discussed.
