| 摘 要： | 在新兴技术迅猛发展的背景下,融合创新成为图书馆的存在状态,但是著作权人专有权的扩张、技术措施的发展以及区块链等新技术的应用使得图书馆的合理使用空间日益萎缩。虽然我国在立法和司法实践中均对图书馆合理使用的拓展以及技术措施的规制进行了探索,但是仍然未能解决图书馆发展所遭遇的合理使用困境。为保障图书馆在新技术环境下实现其公共服务的社会职能,建议在立法上构建合理使用一般条款并完善技术措施的相关规定,同时在司法上确立推行类案检索机制并注重指导案例的指引作用,以立法与司法的良性互动为图书馆的创新发展保驾护航。

| Abstract: | Under the background of rapid development of new technology,innovation becomes libraries' existing status.However,copyright expansion,adoption of technological measures and other new technologies such as blockchain make the libraries living space shrinking.Although in legislation and judicial practice we have explored the path-openness of fair use,the legal regulation of technological measures,the legal dilemma that libraries are faced with still exist.To guarantee the libraries to achieve social function of providing public service in this new environment,the paper proposes to add a general clause in legislating,meanwhile implement the case directing system and encourage judges to play an more active role in judicature so that the benign interaction between the legislation and judicature can escort the development of the libraries. |
