摘    要:传统户籍不仅具有登记、管理的功能,而且还承载了资源配置和利益分配功能,户籍差异是导致公民不能公平享受义务教育这一基本权益的制度性原因之一。现代公民社会的发展要求实现户籍观转型,使户籍信息成为公民作为主权国家民众享有与其他人同等权利的资格和证明。义务教育的公益性和纯公共产品属性决定了公民平等享有这一基本权利的正当性,因此,国家有义务从权利公平、财政公平和评价公平等方面保障义务教育公平发展。

Abstract:Traditional household registration not only has the function of registration and management,but also the function of resource allocation and benefit distribution.And the difference of household registration is one of the institutional reasons that result in the fact that citizens can not enjoy compulsory education fairly.The development of modern civil society requires domicile transformation and it requires making household information qualifications and certifications for citizens to enjoy the same right with others.Compulsory education's properties of public welfare and pure public product make it valid for citizens to fairly enjoy that basic right.Therefore,it is the state's duty to ensure the fair development of compulsory education from the aspect of rights equality,fiscal equality and assessment equality.
