| 摘 要： | 与自愿保险相比,强制保险具有合同订立上的强制性,高度的公益性,非营利性以及受公私法共同调整等特性.虽然许多学者对推行强制保险的合理性提出了质疑,但是由于强制保险具有分散被保险人的责任风险,保护受害人的合法权益以及稳定社会秩序等功能,因此强制保险在世界各国正处于一个快速发展和扩张的过程之中.

| Abstract: | Compared with voluntary insurance,compulsory insurance is compulsory in concluding contract,highly commonweal,non-profit and is adjusted by public-private law jointly.Although many scholars put forward suspicion on the rationality of compulsory insurance,with the function of dispersing the liability risk of the insurant,protecting the victim and stabilizing social order,compulsory insurance is still in the process of rapid development and dilation in many countries. |
