| 摘 要： | "以事实为依据,以法律为准绳",是我国一项基本的法律原则,我们用以审判的"事实"究竟是绝对事实(客观真实),还是相对事实(法律真实)?在司法实践中,客观真实与法律真实发生冲突时不能把两者对立看待,应在联系的观点下全面看待这两种真实。
