| 摘 要： | 目前处理学生体育伤害事故中可依据的法律法规有7部,但在实际执法中却存在相关法律条款不够细致完善,归责原则不够公平等问题,建议：进一步完善相关法律条款,并引入无过错责任原则和公平责任原则以充实和弥补法律归责原则的不足。

| Abstract: | At present,there are seven laws and regulations can be used as the legal basis for dealing with student sports injuries,but in the real situation,there are following problems： not enough relevant legal provisions and not enough fair criterion.It is suggested that we should improve the relevant legal provisions,pull in the principle of no-fault liability and the principle of duty of fair to enrich and make up for the inadequacy of the principle of legal liability. |
