| 摘 要： | 避风港规则作为网络服务商侵权责任的免责条款,在调整网络服务商与版权人的平衡利益方面发挥着重要作用,但在司法实践中对于如何正确理解并适用这一规则却存在诸多不同的观点。通过对170份裁判书的实证分析,发现此类案件具有以下特点:北京和上海法院是受理案件最为集中地区,案件上诉率高于一般知识产权民商事案件,案件数量呈现一个倒U型曲线,案件呈类型化趋势,原告总体胜诉率为87.06%,平均赔偿额为2.29万等。在此基础之上,对各地法院如何运用避风港规则进行了梳理与归纳,提出了促进著作权人和网络服务商利益平衡的政策建议。

| Abstract: | As a kind of tort liability exemptions for internet service providers,safe harbor principle plays an important role in balancing the interests between internet service providers and copyright owners.However in judicial practice,how to correctly and concisely understand and apply the principle becomes a Gordian knot.The analysis on 170 judicial decisions involving the principle shows that,the courts in Peking and Shanghai accepted and heard the most cases of all the country;the number of appealing cases was more than that of general cases involving intellectual property right;the change in trend showed an inverted U-shape;the relative cases presented a trend of classification,87.06% of plaintiffs won the case and average damage was RMB22900.Based on the analysis,the paper summarizes the judicial application of safe harbor principle and put forward the policy advises about the promotion of interest balance between internet service provider and copyright owner. |
