| 摘 要： | 品格证据关乎个人的道德,也反映社会（司法系统）对个人性格特征稳定的认可度。原则上一个人的品格证据不具有可采性,但如果对案件中的某个实质性争议有证明力,其就具有关联性。而其证明力的大小依赖于一个时期的证据生成机制发达程度。某些情况下也仅是作为加强或削弱特定环境下的行为倾向、当事人陈述、被害人陈述、证人证言等证据证明力的证据使用,而不能直接作为认定某一案件事实或者定罪量刑的根据。

| Abstract: | Character evidence refers to the personal moral, and it also reflects the degree of recognition to stable personality features at the view of social （justice system）. Of course, individuals＇ character has no adoptability, but if it has the competency to a substantial dispute of the case , this proof is relevant. Also the competency depends on the extent of generating evidence system at one time. It is only used as an evidence to strengthen or weaken behavior tendency, the statement of parties, the statement of the victim and testimony of witness under particular circumstances .On the other hand ,it can not be the evidence to affirm truth of a case or conviction directly. |
