| 摘 要： | 权利推定是一个具有多层次含义的概念,它是由两个层面,四个层级组成的权利创造性系数递增的权利实践活动;权利推定是一个具有价值定向的概念,它以对人的权利关怀为价值立足点,以反映着这一价值立足点,进而反映着现代法精神的权利本位论为前提;权利推定是一个关联性的概念,包括推定权利与法律这一基础的制度性事实之间的法律自创生系统内部的关联以及推定权利与社会、经济、文化之又一基础性事实之间的法律自创生系统外部的关联。
