| 摘 要： | 一般法律原则是解释法律适用的重要工具.在国际领域,一般法律原则的存在保证了判断的一致性与法律执行的一致性与效率性.为加强国际体育仲裁院作用,一般法律原则适用是体育界一直努力的部分.文章结合一般法律原则的种类,对国际体育活动及全球体育法中的一般法律原则进行阐释和分析.认为国际体育仲裁院虽不能为新兴“全球体育法”提供合法基础,但加强“非种族的”法律秩序,这是一般法律原则下形成的全球体育法,成为全球体育法和国际体育法框架下的“体育法律原则”.

| Abstract: | The "general principles of law" is an important means for interpreting the application of the existing rules of law. In the international field, the presence of these general principles of law guarantees the uniformity of judgments, a uniform and effective administration of law. In order to strengthen the role of CAS, the application of the general principles of law has been continuously pursued by the sports world. The article interprets and analyzes the general principles of law in international sports and lex sportiva according to the categories of those principles. CAS jurisprudence cannot be a legitimizing base for the development of an emerging "Lex Sportiva", but it enhances the aspects of the already "un-ethnical" legal order which called Lex Sportiva in the framework of general principles of law implementation, which grow as "Sports Law Principles" within the field of both Lex Sportiva and International Sports Law. |
