| 摘 要： | 基因工程技术为人类认识自身和体育运动的发展开辟了广阔的前景,也对现有的法律、伦理道德和精神生活提出了严峻的挑战.从法律学的视角出发,对基因工程技术在我国体育领域的立法控制进行了探讨,提出把基因研究与体育运动之间的关系纳入法律调整的范围.但由于基因操作实践在我国体育领域尚未全面展开,建议先就准入规定、总的立法原则及禁止性条款方面做出规定,既弥补了现阶段<体育法>的不足,又可作为时机成熟时立法的"试验田",使之更好地服务于人类社会,促进我国体育运动沿着可持续发展的道路健康前行.
