| 摘 要： | 本文运用有关法学原理,遵循体育自身规律,对体育彩票热销现象作出分析。通过对国内外体育彩票历史回顾,粗略地描述了其发展轨迹;依据法律,对彩票与赌博从性质上进行了界定;运用《合同法》,对体育彩票买卖行为作了定性的阐述;对目前体育彩票经营管理中存在的问题,提出了法律对策;在此基础上,本文从宏观和微观的角度,从体育事业阶段利益和长远利益相结合的角度提出了我国体育彩票发展的方向。

| Abstract: | Recent years, sport lotteries are having a heated marketing continuously. This arti- cle endeavors to analyse this phenomenon by applying the legal principles and following the sport regulations; to describe its general developing track by the retroopetion of the history of sport lottery home and abroad; to demarcate the nature distinctions, according to law, between lottery and gambling; to elaborate the conclusive definition of the lottery trade by using "Law of Contract"; to propose the countermeasures against the problems exsisting in the sale and management of sport lottery. On the basis of all mentioned above, this article propose the di- rection of sport lottery's development from the macrosoopic and microcosmic vimpint, as well as for the angle of the conbination of the temporary and long-term profit of sport. |
