| 摘 要： | 违背体育道德的现象日益泛滥，道德规范失效后，作为最后屏障的法律调整竟然也难以有效发挥规制作用。究其原因是体育法立法中伦理化价值的缺失。综合运用价值分析方法和法哲学分析方法，认为无论从体育发展的现实要求而言，还是从法律规范的完善与评判而言，我国体育法都亟须伦理化。提出应采取相应的完善措施：树立“以人为本”、“权利本位”的立法理念；突破单一的体育社团内部处罚机制，将违背体育道德行为纳入个人信用制度；完善《体育法》中法律责任的相关规定。

| Abstract: | More and more immoral sport behaviors bring great challenge to the enforcement of the sports law. The caution is that it lacks of ethical institutions in sports law. Using value - analyzing method and legal philosophy method, considering the realistic foundation of gym and the improvement of the code, it＇ s no time to delay to establish the ethical sports law. Then the author puts forward the strategies for establishing ethical sports law. Firstly, we should establish people - oriented and right - centeredness conception. Secondly, the punishment should not be given only in sports association, but also be in the private credit system. Thirdly, we should consummate the legal responsibility in Sports law. |
