| 摘 要： | 学校体育伤害事故频发,由此引发的纠纷不断且难以得到有效解决,严重影响了学校体育工作的正常、有序开展,其根本原因在于预防和处置两方面都存在制度性障碍.为此,建议：以平等、公正的法制理念,完善教育法规;成立专门的学校体育安全管理机构;设置针对性强的学校体育伤害保险;出台学校体育安全法.

| Abstract: | Frequent injury accidents in school physical education has triggered increasing disputes which cannot be effectively resolved thus seriously restrain schools from carrying out a normal and orderly sports work, which is rooted in the institutional obstacles. To solve the disputes, an equal and just legal idea to im- prove educational laws and regulations is necessary. In addition, establishing specialized safety agencies of school physical education is required. And the practice of injury insurance in school physical education must be enforced. Meanwhile, safety law of school physical education is badly expected. |
