| 摘 要： | 摘要：对于创新企业而言，是否拥有知识产权并非目的，其真正目的在于通过知识产权创造激励机制，高效利用知识而创造与获取价值。在开放式创新中，作为占有制度的重要内容，知识产权随着企业占有行为的转变而发生了演化。本文在对开放式创新下企业的占有行为转变进行分析的基础上，提出了关系性知识产权，并结合开放式创新的典型案例对其具体运用进行阐述，旨在回答企业如何灵活运用知识产权从开放式创新获利这一重要问题。这对于企业的开放式创新实践，具有重要的借鉴意义与参考价值。
