| 摘 要： | 公诉案件的举证责任由控诉方承担,这是刑事诉讼中举证责任分配的一般原则,但在特殊防卫案件中,由于特殊的立法目的以及对特殊防卫案件追究的困难程度决定了可以采用特殊的举证原则,即由被告人承担对特殊防卫案件的举证责任,如果其未能履行这种责任,可以推定其有罪。由于特殊防卫案件的司法认定以及控辩双方在诉讼中强弱相比的特殊地位,被告方只需针对公诉机关的犯罪指控,达到证明特殊防卫事实存在之可能性大于其不存在之可能性,即完成了举证责任。这不仅考虑到了而且可以弥补特殊防卫制度在实施中可能出现的疏漏,在很大程度上避免行为人假借特殊防卫而实施犯罪。

| Abstract: | A case of public prosecution indictment of burden of proof by the recipient undertaken in criminal lawsuit,this is the general principles of the allocation of the burden.But in special defense case,because of the special purpose of legislation and the difficulty of investigating the special defense case determine to use speacial of proof principle,i.e.,the defendant is liable for special defense case burden of proof,and if it fails to perform this responsibility,it can be presumed guilty.Due to the special defense case of judicial cognizance and both of the accused and the defendant in litigation weak compared the special position of the defence simply for prosecuting authority says that criminal charges,to prove the possibility of special defense factual existence is greater than the possibility that does not exist that completed the burden of proof.This not only takes into consideration and can compensate for special defense system in the implementation of possible omissions and largely avoids actor cloaking special defense and implementing crime. |
