| 摘 要： | 为严密法网，保持国家工作人员职务行为的廉洁自律性，有效遏制腐败之风，我国刑法设立了巨额来源不明罪。但是，由于种种原因，该罪名在设立过程中，存在一些实体与程序上的问题。为此，应当分析巨额财产来源不明罪的立法缺陷，并因应修改完善之。

| Abstract: | In order to make the law tight, keep state functionaries act of self-discipline, and effectively curb corruption, China＇s criminal lawhas set up a crime for a huge amount of unidentified sources. However, due to various reasons, there are a number of physical and proceduralissues in the process of establishing of the charges. The include is that we shoutd analyze the legislative defects of large amounts of propertyfrom unidentified sources, and then try to make changes and improve them in later legislation as a result. |
