| 摘 要： | 高等教育合同属于民事合同,主要调整高等学校与受教育者之间的民事关系。高等教育合同的履行是一个非常复杂的问题,需要从履行结果、履行主体、质量条款等方面进行厘清。在高等教育合同的订立阶段和履行阶段容易产生纠纷,各方当事人可以利用缔约过失责任和违约责任等法律手段来维护自己的权利。

| Abstract: | Higher education contract belongs to the civil contract.It adjusts the civil relationship between the university and the student.The performance of higher education contract is very complicated,including performance results,performance party,quality clause.The disputes are easily made at the formation stage and performance stage.The contract parties can safeguard the right by quoting the culpa in contrahendo and default liability. |
