| 摘 要： | 检察公益诉讼在档案行政管理领域的拓展,有助于满足档案公共利益充分保护与档案行政管理权力全面监督的二元现实需求。诉的利益理论、客观诉讼理论以及风险预防理论为检察公益诉讼在档案行政管理领域的拓展提供了多维证成进路。尽管“诉讼法”模式、“档案法”模式以及“专门法”模式均可作为检察公益诉讼在档案行政管理领域立法建构的可选模式,但从经济性与协调性角度看“诉讼法”模式更为适宜。立足于检察行政公益诉讼的现行规定,检察公益诉讼在档案行政管理领域的立法建构可从受案范围的扩展与诉前程序的优化两方面进行规范回应,期冀实现档案检察行政公益诉讼制度在我国的健全与善用。

| Abstract: | The expansion of procuratorial public interest litigation in the field of archives administration is helpful to meet the dual realistic needs of full protection of archives public interest and full supervision of archives administration power. The interest theory, objective litigation theory, and risk prevention theory of litigation provide a multi-dimensional justified approach for the expansion of procuratorial public interest litigation in the field of archives administration. Although the "procedure law" model, the "archives law" model and the "special law" model can be used as optional models for the legislative construction of procuratorial public interest litigation in the field of archives administrative management, the "procedural law" model is more appropriate from the perspective of economy and coordination. Based on the current provisions of procuratorial administrative public interest litigation, the legislative construction of procuratorial public interest litigation in the field of archives administration can be standardized from two aspects: the expansion of the scope of accepting cases and the optimization of pre litigation procedures, hoping to realize the sound and good use of archives procuratorial administrative public interest litigation system in China. |
