| 摘 要： | 公共图书馆制度是适应人类社会文明进步的需要而产生的公益制度,它由初期的公益活动发展为当今国家为保障公民文化权利实现的重要公益制度,充分体现社会效率和公平正义的价值;公共借阅权制度是维护版权人个人利益的制度;对于公权力而言,如果在公共资源无法同时满足公共图书馆制度的公益和公共借阅权制度的个人利益时,应当优先维护公共图书馆制度的公共利益。

| Abstract: | The system of public library is the commonwealth system that had come into being for fitting the situation of the civilization progress,and it has developed into a system now which the cultural rights of citizen implement had been ensured by public authority of country after incunabular commonwealth activity.It is embodiment of value of societal efficiency and social justice.The system of Public Lending Right is the one to protect private advantage of rightsholders with copyright.It should be maintained the public advantage if the resources are not enough to meet the needs of public advantage and individual advantage equally. |
