In a criminal procedure,if the offender and the victim negotiate to solve the criminal case in the way of confession,compensation and apology,the specialized agency terminate the criminal responsibility investigation of the offender or give lighter punishment to the offender.This form of case treatment method is defined as criminal reconciliation.[1](P191)The system dated from 70s of last century when a reconciliation experiment of‘Victim-Offender’appeared in Ontario,Canada.After that,the method was introduced to America and some European countries.The practice of the method in western countries attached the attention of Chinese law society,and some regions has made legal attempts.However the author hold the view that the criminal reconciliation lacks enough rationality and feasibility,so that it shocks the basic principle of the existing criminal law,corrodes the social psychological basis of the law,and aggravates the judicial corruption.The method has theoretic defects,and it should not be promoted in current judicial practice. 相似文献

Politeness symbolizes human civilization,and is one of conduct codes of human beings.As a social activity,language use is subject to this code as well.Pragmatic vagueness is a common phenomenon in spoken discourse.Furthermore,it is an important strategy widely used in teachers’ spoken language.Based on the politeness principle,this thesis explores the pragmatic vagueness by analyzing teachers’ spoken discourse.Employing pragmatic vagueness in teacher’s spoken language can smooth the relationship between teachers and students,and help teachers gain foremost effect on the education to their students. 相似文献

Greimas’s Semiotic Square is a new approach in analyzing literary works.Based on Sassure and Jacnson’s claim on binary opposition,Gereimas extends it to four actants and adds contradictory relationships.By assign meanings to the four actants,an analysis of the complicated relationship between the roles in a text can be made and a revelation of the theme of the text can be realized.Previous studies of this novel take it as an excellent work revealing loneliness and isolation is thought to be the basic condition of human existence.Other study covers the effects of the unrequited love.Quiet differently,this paper tries to interpret this novel by Greimas’semiotic square and thereby revealing the widely accepted theme of this novel that isolation and loneliness is the final destiny of human being in modern society. 相似文献

Criminal law consciousness, which is the theoretic base of criminal law, is the public’s view, attitude and judge about a criminal conduct and the current criminal law. It is historical and cultural.The ethical arguement, "A murderer must repay with his life just like a borrower with money" is the concept to judge, the theoretic base of criminal law consciousness and the moral standard of Chinese. Code-switching between English and Chinese usually occurs in students’ talk when they are involved in taking communicative language activities in college English class. This paper studies the situations in which students are likely to use codeswitching and analyzes it from the perspective of the mental world in Verscheren’s Adaptation Theory. It shows that inadequate mastery of English language, cultural differences and the improper adjustment to context may lead to students’ using of codeswitching.
