《关于未成年人犯罪记录封存的实施办法》并未对未成年人犯罪记录封存的实质条件作出规定,但是从设置犯罪记录封存制度的目的与保护社会利益的角度分析,目前的未成年人犯罪记录封存中“五年有期徒刑”的“一刀切”式的形式条件已经不能满足现实需要,建议从罪错未成年人的犯罪主观动机、罪质、考验期表现等更为实质的方面考察其是否能够适用未成年人犯罪记录封存制度。 相似文献
