The current Examination Guidelines provide that when the Chinese applicant is an entity, he/it is required to have the status of legal person, otherwise, he/it would not be permitted to apply for patent. This provision, having excluded some non-legal-person organisations that are lawfully established, capable of bearing liability, and entitled to the right of civil action from the scope of protection under the patent law, is detrimental to the encouragement and transfer of invention-creations. 以“引进来”与“走出去”的双向共生视角,采用面板回归方法系统研究中国资本流动的交互创新溢出影响,结果发现：FDI对区域创新具有动态抑制性影响,而OFDI的创新溢出呈现出“U”型三重门槛特征,较高强度的OFDI才能促进区域创新提升;“引进来”与“走出去”存在显著的交互创新溢出,高强度的OFDI有助于扭转FDI创新溢出瓶颈,而适度的FDI 有利于撬动OFDI创新溢出最大化。进一步研究还发现,中国资本双向流动的交互创新溢出存在显著的空间异质性,高强度的OFDI有利于扭转东部地区FDI创新溢出瓶颈,但并未改变其他地区FDI的创新抑制影响;东部地区FDI能够正向调节OFDI创新溢出效应,而中西部地区过高强度的FDI会弱化甚至抑制OFDI创新溢出。因而要分层次科学协调“引进来”和“走出去”,系统激励资本流动的创新溢出红利。 相似文献

中西译论各自所倡导的“似”和“等”翻译原则,都有其美学传统。本文从中西美学思想在艺术实践中的体现入手,探讨了中西美学思想在翻译中的体现,认为“形式对等”和“形似”、“动态对等”和“神似”在诸多方面有共同之处,可以对其加以沟通,并就在英汉翻译实践中如何运用它们提出了自己的观点。笔者认为,像“形似”和“神似”一样,“形式对等”和“动态对等”也可作为英汉文学翻译的原则,以“等效原则”作为衡量的尺度。“等效原则”也是相对的,但应成为译者努力争取的目标。 相似文献

Stanley Milgram's study of "obedience to authority" is one of the best-known psychological experiments of the twentieth century. This essay examines the study's special charisma through a detailed consideration of the intellectual, cultural, and gender contexts of Cold War America. It suggests that Milgram presented not a "timeless" experiment on "human nature" but, rather, a historically contingent, scientifically sanctioned "performance" of American masculinity at a time of heightened male anxiety. The essay argues that this gendered context invested the obedience experiments with an extraordinary plausibility, immediacy, and relevance. Immersed in a discourse of masculinity besieged, many Americans read the obedience experiments not as a fanciful study of laboratory brutality but as confirmation of their worst fears. Milgram's extraordinary success thus lay not in his "discovery" of the fragility of individual conscience but in his theatrical flair for staging culturally relevant masculine performances. 相似文献
