文章以《刑案汇览》的诬告案件为基础,探讨了清代刑事审判中的依法判决问题。研究显示,虽然官方要求司法官员必须依法判决,但司法实践中非依法判决的现象比比皆是。原因是中国古代的司法审判以情理为判决的价值取向,反映在刑事审判中就是司法官员以＂情罪相符＂为目标,但官方又强调严格依律判决,所以清代的刑事审判其实是一个平衡罪名与罪刑的过程。 相似文献

清代普通家庭对夜间“无故入人家”的外人,可以“登时”实施一定的防御行为。此种防卫权是家庭对自身财产和成员的一种有力保护,弥补了国家公共治安调控的不足。《刑案汇览》中的诸多案例反映了当时的律法认可普通家庭实施这种防卫权,但对防卫的时间、防卫的行为等加以了严格限制。 相似文献

在成文法的背景下,法律是最直接的审判依据,在司法实践中,自应得到严格规范地适用。这是依法审判的基本要求。然而,严格适用法律并不意味着法律是束缚现实的框架。此外,成文法的固定性与保守性也造成其无法涵盖所有的社会问题,这是依法审判面临的重要议题。通过研读《刑案汇览》这部清代刑部案例汇编,可以发现依法判决并不是单一、教条地适用法律,而是通过司法官员的努力,能够多层次、灵活地展现出依法判决的不同情况,进而解决现实问题。 相似文献

在中国古代农耕文化中,"教不严,师之惰",师父有权对徒弟进行教育和责罚。在《刑案汇览》和《驳案汇编》中的诸多案例反映出清代律法认可师父的责罚权。但当时律法也对师父责罚权的实施范围和方式设置了限制条件,不得随意行使。首先,师徒关系必须为法定的师徒关系,行业不同,认定标准宽严不一。其次,师父责罚"违犯教令"的徒弟是"以理殴责",不能临时起意随意殴打,且不能针对徒弟轻微过失而毒打,否则丧失师徒之义。再次,在奸盗特殊情况下,师父责罚徒弟不受法律保护。 相似文献

吴梅村的诗歌在清代已有“诗史”之称.靳荣藩的《吴诗集览》作为最早的吴梅村诗歌笺注本,对吴梅村“诗史”的理解颇有代表性.《吴诗集览》沿袭《本事诗》中的“诗史”观念,详证梅村诗中的史实.《吴诗集览》征引的材料仅限于《明史》及《御撰资治通鉴三编》,使梅村的“诗史”精神打上了浓厚的官方色彩.另外《吴诗集览》忽视了吴梅村“诗史”观念中对士人心态史的关注. 相似文献

儒教血缘社会“君君,臣臣,父父,子子”的注重等级秩序的世俗伦理——政治传统,需融摄佛教“出家”以求涅檠的出世宗教文化,这在我国古代精神文化、社会制度方面都有体现。剖析清《刑案汇览》和《大清律例》中的涉佛案例和相关法律规定,可见其法律制度有两方面的体现了以儒摄佛：一是对僧人更强化儒家伦理之实行。僧人同俗人一样要服从法中之“礼”,并要服从合于“礼”之精神的法中之“戒”;二是防范僧徒冲击儒家政治、社会秩序。为切断佛教与民间宗教之间的联系,严防僧人传播“不经”思想,严防僧人结社。 相似文献

我国《刑法修正案（八）》将醉驾行为作为犯罪处理。＂醉驾＂入罪实施一年来,醉酒驾驶高发势头得到了有效遏制,但是司法实践中缺乏对醉驾判处缓刑、免刑、从轻、从重处罚的详细标准,导致各地法院对同样的案件处理结果不一样。细化醉驾的量刑标准,区别对待不同的醉驾案件,避免选择性司法,才能更好地体现法律对每个醉驾者的公正裁决。 相似文献

The problem on the geometrc inequalities involving an n-dimensional simplex and its inscribed simplex is studied. Aninequality is established, which reveals that the difference between the squared circumradius of the n-dimensional simplex andthe squared distance between its circumcenter and barycenter times the squared circumradius of its inscribed simplex is not lessthan the 2(n-1)th power of n times its squared inradius, and is equal to when the simplex is regular and its inscribed siplex is atangent point one. Deduction from this inequality reaches a generalization of n-dimensional Euler inequality indicating that thecircumradius of the simplex is not less than the n-fold inradius. Using virtual reality for interactive design gives a designer an intuitive vision of a design and allows the designer to achieve a viable, optimal solution in a timely manner. The article discusses the process of making the Virtual Reality System of the Humble Administrator＇s Garden. Translating building data to the Virtual Reality Modeling Language （VRML） is by far unsatisfactory. This creates a challenge for computer designers to do optimization to meet requirements. Five different approaches to optimize models have been presented in this paper. The other methods are to optimize VRML and to reduce the file size.
