瑞士法框架下体育仲裁“裁决修正”探讨

瑞士联邦最高法院将裁决修正适用于国际仲裁的先例，使得这一原本属于瑞士国内法上的救济手段可以适用于国际仲裁中，体育纠纷大多属于国际仲裁的范畴。结合孙杨案件，对瑞士法框架下的体育仲裁"裁决修正"进行了探讨。研究认为，在瑞士法院的司法实践中，仲裁程序涉及刑事犯罪或裁决作出后发现新的民事证据，当事人均可申请瑞士联邦最高法院或其他各州地区法院修正仲裁裁决。刑事犯罪由于具备较强的司法公信力，容易在"裁决修正"中受到法院青睐，应当坚持刑事证据优先的原则。针对发现新的民事证据，需要满足时限条件、勤勉义务、重大影响和法律利益四项条件；同时排除一些禁止性规定才可能得到法院的支持。孙杨案件若以裁决修正理由继续上诉，获得胜诉判决的可能性基本为零。  相似文献

我国低碳航运产业价值链的结构乘数效应

针对航运低碳投资支出巨大的问题，运用结构性乘数，对我国用于低碳航运产业价值链中的支出产生的乘数效应进行研究.由两部门计算的简单投资乘数为1.547 7，由四部门计算的投资乘数均值为1.293 1.从长期看，乘数效应反映出航运低碳产业的投资收益大于投资支出，对航运业低碳减排具有现实和经济意义.  相似文献   

我国体育用品制造业国际转移的趋势及动力机制——基于全球生产网络视角

我国体育用品制造业国际转移呈现出网络化、多元化、集群化、主动化的新趋势，其动力来源有三点，一是寻求我国体育用品制造业价值链的重构，二是试图跨越后发国家可能面临的价值链固化的"网络陷阱"，三是追逐包括竞争优势和网络权力等隐形收益在内的综合利益最大化。但是，这种自觉行动和主动作为可能受到价值链上端发达国家的阻击。因此，我国体育用品制造业要利用研发设计和品牌营销价值链的发育突破门限效应，积极开展跨境并购和逆向投资活动弥补比较劣势，并逐步回归到研发本土化，利用国内中小体育用品企业构建由自己主导的价值链，以全球布局应对潜在的贸易风险。  相似文献   

Destined to Design? How and Why Australian Women Choose to Study Industrial Design

Despite over three decades of legislation and initiatives designed to tackle the traditional gender divide in the science, technology and design fields, only a quarter of the registered architects in Australia are women. There are no statistics available for other design disciplines, with little known about why women choose design as a career path and who or what influences this decision. This qualitative research addresses this knowledge gap, through semi‐structured in‐depth interviews conducted with 19 Australian women who completed an industrial (product) design degree. Thematic analysis revealed three key themes: childhood aptitude and exposure; significant experiences and people; and design as a serendipitous choice. The findings emphasise the importance of early exposure to design as a potential career choice, highlighting the critical role played by parents, teachers, professionals and social networks.  相似文献

Learning the American Way: Sports International and American Soft Power

Abstract

From 1962 to 1968, the United States Government along with private entities funded the training of athletes from developing nations through a non-profit organization named Sports International. Led by former Peace Corps member David Dichter, Sports International sought to enhance America’s image in Africa, Latin America, and Asia. The initial aim of the programme was to train athletes to compete at the 1964 Olympic Games in Tokyo. The theory behind Sports International centred on the notion that helping developing nations achieves athletic success would influence them to view the United States more favourably. The idea to form Sports International came in the midst of the Cold War as the United States and the Soviet Union battled on a multitude of fronts. This article argues that American leaders worried about the presence of the Soviet Union in developing countries and sought ways to maximize American influence in those areas. The theory of soft power, a concept most prominently explicated by American international relations theorist Joseph Nye, forms the framework for this study. By analysing Sports International through this lens, this article demonstrates several problems which might ensure should one overemphasize the effect of sport on a nation’s soft power.  相似文献   

基于理论研究视角下体育与经济增长和经济发展的关系

摘要：近几年体育和社会经济文化发展的关系日益紧密，体育消费和体育产业在经济增长和经济发展中的作用日益重要且多元化，体育产业吸引着越来越多的要素投入，现实要求理论研究更加深入且紧密结合实际。从理论研究进展的视角，运用文献资料法，以体育与经济增长和经济发展的关系为研究对象，对2001—2008年和2009—2015年2个阶段我国理论界的相关研究成果进行了较为系统的梳理。结果显示，在研究内容方面，体育产业将成为新的经济增长点、体育经济是克服经济衰退的特殊产业经济、体育产业的发展应重视绿色和环保等观点具有前瞻性和创新意义。在研究方法方面，第一阶段的定性分析和规范分析较多，第二阶段定量分析和实证分析逐渐增多。在对已有研究成果客观简要评价的基础上，提出未来一段时期体育与经济增长和经济发展关系研究的着眼点：1）加强跨学科理论研究；2）加强体育有效供给研究；3）加强体育与经济发展关系的研究；4）理论联系实际，加强定量研究，目的旨在使研究成果更好地服务于政府决策和企业发展。  相似文献   

Kinematic analysis of the drag flick in field hockey

Attaining high speed of the stick head and consequently of the ball is essential for successful performance of the drag flick in field hockey, but the coordination pattern used to maximise stick head speed is unknown. The kinematics of the drag flick was studied in ten elite hockey players who performed twenty shots each towards a target located 1.5 m high. A 150 Hz active marker motion analysis system was used, alongside two force plates to detect foot touchdown. Angular velocity and contribution to stick endpoint speed of upper body joints were analysed. Repeated measures ANOVA was used to compare timing of onset and peak angular velocities between joints. Participants used a kinematic pattern that was close to a proximal-to-distal sequence. Trunk axial rotation and lateral rotation towards the target, right wrist flexion and left wrist extension were the main contributors to stick endpoint speed. Coaches should emphasise trunk rotations and wrist flexion and extension movements for maximising stick head speed. Given the high level of the participants in this study, the coordination of joints motions, as reported here, can serve as a guideline for drag flick training.  相似文献
